CON 4 E PT LOT B RP 3R3851; PT PART 4, Kincardine (Bruce Township); PLAN 3M113 BLK 20, Kincardine (Bruce Township); PLAN 3M-113 LOT 2, Kincardine (Bruce Township); PLAN 3M-113 LOT 12 3R-3861; PART 10, Kincardine (Bruce Township); PLAN 3M-113 LOT 13 3R-3861; PART 9, Kincardine (Bruce Township); PLAN 3M-113 LOT 14 3R-3861; PART 7, Kincardine (Bruce Township); PLAN 3M113 PT LOT 6, Kincardine (Bruce Township); PLAN 3M-113 LOT 7, Kincardine (Bruce Township); PLAN 3M-113 LOT 8, Kincardine (Bruce Township); PLAN 3M-113 LOT 9, Kincardine (Bruce Township); PLAN 3M-113 LOT 10, Kincardine (Bruce Township); PLAN 3M113 PT BLK 19, Kincardine (Bruce Township); and, BRUCE CON 3 PT LOTS C D AND;E RP 3R3851 PARTS 2 AND 3, Kincardine (Bruce Township). _________________________________________________________________ WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the councils of municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine has enacted By-law 2003- 25, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine desires to amend By-law 2003-25; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further amended by changing thereon from ‘Energy Centre Industrial Light Holding (ECI1-h)’ Zone and ‘Environmental Protection (EP)’ Zone to ‘Energy Centre Industrial Light Holding Special (ECI1-a-h)’ Zone and ‘Environmental Protection (EP)’ Zone on those lands described as BRUCE CON 3 PT LOTS C D AND;E RP 3R3851 PARTS 2 AND 3, Kincardine (Bruce Township), as outlined on the attached Schedule ‘A’. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further amended by changing thereon from ‘Energy Centre Industrial Heavy Holding (ECI2-h)’ Zone and ‘Environmental Protection (EP)’ Zone to ‘Energy Centre Industrial Heavy Holding Special (ECI2-a-h)’ Zone and ‘Environmental Protection (EP)’ Zone on the following lands in the Municipality of Kincardine, as outlined on the attached Schedule 'A': CON 4 E PT LOT B RP 3R3851; PT PART 4, Kincardine (Bruce Township); PLAN 3M113 BLK 20, Kincardine (Bruce Township); PLAN 3M-113 LOT 2, Kincardine (Bruce Township); PLAN 3M-113 LOT 12 3R-3861; PART 10, Kincardine (Bruce Township); PLAN 3M-113 LOT 13 3R-3861; PART 9, Kincardine (Bruce Township); PLAN 3M-113 LOT 14 3R-3861; PART 7, Kincardine (Bruce Township); PLAN 3M113 PT LOT 6, Kincardine (Bruce Township); PLAN 3M-113 LOT 7, Kincardine (Bruce Township); PLAN 3M-113 LOT 8, Kincardine (Bruce Township); PLAN 3M-113 LOT 9, Kincardine (Bruce Township); PLAN 3M-113 LOT 10, Kincardine (Bruce Township); and PLAN 3M113 PT BLK 19, Kincardine (Bruce Township). 3. The 'h' holding symbol shall be removed in accordance with the following: a. That an Archaeological Assessment for development on lands that exhibit high archaeological potential has been submitted to the appropriate Approval Authority. b. That a Justification Report has demonstrated compatibility with existing uses, and in accordance with the Official Plan, to the satisfaction of the Municipality. The report may include smoke, noise, dust, odour, vibration, traffic, or other studies as the Municipality deems appropriate in the circumstances, to demonstrate that impacts from adverse effects will be acceptable. 4. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990, as amended. 5. This By-law may be cited as the “Amendment to Comprehensive Zoning By-law 2003-25, Farrell Drive (Bruce Township) [BEC Business and Innovation Centre Inc.] By-law”. READ a FIRST and SECOND TIME this 14th day of November, 2022. READ a THIRD TIME and FINALLY PASSED this 14th day of November, 2022.
