THE CORPORATION OF THE TOWN OF KINCARDI E
BY-LAW No. 2273
BEING A BY-LAW PROVIDING FOR THE CONTROL, LIC SING AND
REGISTRATION OF DOGS WITHIN THE TOWN OF KINC
WHEREAS IT IS PROVIDED bI Sectit'1ll 5 of T DOG TAX and
LIVE STOCK and POULTRY PROTECTION CT, Revised Sta utes of Ontario
1970, Chapter 133, as all18nded that Councils of Mun cipalities may
pass by-laws for the licensing and regulating the gistration of
dogs for imposing a license fee on the owners of t em.
THEREFORE the Council of the Corporation of the Town of
Kincardine enacts as follows:
PART 1
(a) That By-law Dumber 2257 of the Town of K ncardine be and
the same is nereby repealed.

LICENSING AND REGISTRATION OF DOGS:
Every owner or harbourer of a dog in the own of
Kincardine shall within one week after the dog come into his
possession cause such a dog to be licensed and regi tered in the
office of the Clerk of the Municipality for the per od which will
expire' on tþe last day of December and shall therea ter annually on
or before the fifteenth day of February in each yea cause such dog
to be again licensed and registered for one year fr m the first day
of January and shall at the time of licensing and r gistration pay
the license fee applicable thereto, which is hereby imposed upon
such owner as fo1fows:
For each male dog or spayed female.................

2. Any owner not procuring a license for hi dog on or
before the fifteenth day of February in each yea shall have a
ticket mailed to him by registered mail to his st known place
of residence. Any person issued under the pro vis ons of this
by-law for an alleged contravention may within 4 hours after
the issuance thereof pay to the Clerk of the Mun"cipa1ity or
such other person designated by the Council of t e Municipality
to receive such payment the sum of $10.00 for th first offence
in anyone thirty-day period and $15.00 for the s cond and
subsequent offence or offences in the same thirt day period.
This payment shall be received as the payment 0 a penalty in
full satisfaction with respect to the alleged off nce and a
receipt therefor shall be given to the person ma "ng payment.
The owner shall also at this time purchase the re uired number
of licenses.
3. No dog tax shall be levied within the To
pursuant to the provisions of Section 2, of the s
and Live Stock and Poultry Protection Act while t
remains in force.
4. (a) On payment of the :Ii cense fee referre
Section 1, the owner shall be furnished with a do
license for each dog so licensed and registered a
twenty-five cents (25¢) per. tag.
(b) The owner shall keep the current tag
on the dog at all times during the year, save and
the tag and collar may be removed while the dog i
lawfully used for hunting deer in the bush.
(c) The tag shall bear a serial number an
which it was issued and a record shall be kept by
other officer designated for that purpose, showin
address of the owner and serial number of the tag

5. A dog if found, whether on or off the pro

Municipality.
3. A dog which is found running at large con rary to the
provisions of this part may be seized and impound d in the dog
pound; a dog so impounded shall be held for a per"od of not
less than THREE (3) days, and if not claimed and eleased by ,
the owner thereof within such a period of time, y then be sold,
destroyed or otherwise disposed of at the discret on of the
poundkeeper; a dog so impounded shall not be'rele sed until the'
owner thereof shall pay to the Clerk or other des gnated Officer,
the sum of $5.00 for each day or part thereof aft r the first
day during which the dog has been so impounded pl s a penalty of
$10.00 in the case of a dog impounded for the fir t time or a penalty
of $15.00 in the case of a dog impounded for the econd or
subsequent tlme in the same calendar month.
4. (a) If the owner or guardian of an impoun ed dog can be
identified said owner shall be notified by the Ca ine Control
Officer, which notification shall be sufficiently given if sent
by first class mail (prepaid) to the last known p ace of residence
of said owner. If the dog is not claimed within tree (3) days
and said dog is destroyed then the owner shall be r the cost of
destruction.
(b) In addition to penalties provided for
procedure of the Summary Convictions Act shall ap
