THE CORPORATION OF THE TOWN OF KINCARD¡NE
BY-LAW NO. 4224
A BY-LAW TO ESTABLISH A SICK LEAVE CREDIT PLAN FOR ALL FULL-
TIME EMPLOYEES OF THE TOWN OF KINCARDINE
WHEREAS by paragraph 65 of Section 3$2 of the Municipal
Act it is provided that By-laws may be passed by the Councils
of all municipalities for establishing a plan of sick leave
gratuities for municipal employees:
THEREFORE the Council of' the Corpora~ion of the Town
of' Kincardine enacts as f'ollows:
There is hereby established for all full-time employees
of the Corporation of' the Town of Kincardine a þlan of sick
leave gratuities, subject to the conditions her,inaf'ter set f'orth;
1. Sick leave shall be accumulated at the rateiof 1.75 days for
each calendar month of' service commencing t&e 1st day of
January, 1970.
2. A new employee shall not be eligible for th.se said credits
until he or she has been employed by the Cotporation for at
least nine months; provided that when such +mployee has
,been continuously so employeed f'or such nin. month probation-
ary period he or she shall then be entitled to receive a
credit retroactin to the date on which his or her employment
commenced.
3. There shall be a limitation of six months u~on the amount of
sick leave that may be accumulated by any o~e person.
4. There shall be no sick leave remuneration if an employee is
absent through an accident or illness f'or ~ich he or she is
receiving Worlanen' s Compensation.
5. Where an employee (a) is absent by reason of injuries caused
by another individual for a period in exces~ of the employee·~
accumulated credits and, (b) recovers damag,s, by way of' action
or settlement f'rom such individual in exces~ of the amount
required to pay the employee's actual expen~es caused by his
injuries, the employee shall ref'und to the Treasurer any pay-
ment of salary received in excess of his cl1ldits.
6. No credit shall be given to an employee in ..ny month who is
absent f'rom duty in that month without leav..
7. After three days absence because of sicknes~ no leave with
pay shall be allowed unless a certificate by a duly qualified
medical practitioner is forwarded certif'ying to the inability
of the employee to attend to his or her off!cial business and
if the sickness continues, from time to timtl thereafter, as
may be required. '

8. Employees who are discharged or voluntarily, leave their
employment prior to five years service shalt receive no
credits or remuneration f'or unused accumulajoed sick leave. _

9. An employee on completion of five years satisfactory service
shall on termination of' his or her employem.nt, be entitled
to an amount equal to his or her remuneratiøn for one-half of
the number of days standing to his or her c:tedit for his or
her accumulated unused sick leave but the a$ount so paid
shall not exceed one-half a year's earnings paid at the rate
received by him or her immediately prior to termination of
employment.
10. A monthly report of any sick leave will be filed in the
Treasurer's Off'ice by all department heads ~y the 10th day
of' the following month.
ll. By-law 3169 be and the same is hereby repea1ed.
