THE OORPORATION OF THE 'IDWN OF IKINCARDINE

BY-LAW NO. 4195 ¡

BEING A BY-LAW to provide for the estab1is~ent and operation
õf the Community Centre and to authorize t~e operation of
recreational programs pursuant to the Comm~ity Centre Recreation
Act.
·
1. THE OOUNCIL OF THE OORPORATION ENACTS 4s FOLIOWS:
(a) Pursuant to the Community Centre ~ecreation Act and
regulations made thereunder, the qommunity Centre has
been established by By-law 3080 a~d the Recreation Programs
have been estab1ished by By-laws 11564 and 3167 for the -
residents of the Town of Kincardi~e and District and shall
be managed and controlled on beha11f of the Council of the
Town of Kincardine by a Committee I known as Kincardine and
District Community Centre Recreat~on Board.
2. The Committee shall be appointed by th~ Council of the T~wn of
Kincardine and the Council of~he Town1hip of Kincardine.
(a) Two members of the Council - of th~ Town of Kincardine and
one member from the Council of th~ Township of Kincardine.

(b) Four reBidents of the Town of Kin ardine who are qua1ified
to be elected as members of Counc·l
(c) Two residents of 'the Township of incardine who are
qualified to be el ect.ed: as member of- Council.
rd) Appointment of Counc11-members S1all be for a two yèar
term and the non-council members two year 'term, excepting
the initial appointment, when one member shall be appointed
for a one year term.
3. The appointment of the said Community ~entre Recreation Board
should.-be made annually at the first r~gular meeting of the
Counc.il,.- or as soon thereafter as it . s expedient..- The
members shall hold office until their uccessor shall have been
appointed, provided that aÌI members s all hold office during
the pleasure of the Council of the Co oration.
Subjeet to the approval of Council, th said Board shall
formulate policies, rules and regulati ns for and relating to
the administration of the Comm~ity Ce~tre and Re~reat*on
Programs. The said Board shall hold t40 regula!' monthly meetings.
At any meetings of the said Board a qU4rum shall consist of a
minimum of five members. I

2. That paragraph 4 of BY""law 4195 be amended to
"The Council establish a Bank Account on beha
the said Board to be known as the Kincardine
District Community Centre Recreation Board.
(a) The signing officers for the Bank Account sha be
appointed of the Board.
(b) The books and the accounts of the said Board be
kept by the Treasurer of the said Board.
(c) The Secretary shall be appointed by Kincardine Town Council.

The said BOard shall elect a Chariman annua~IY from among its
members and such other officers as may be rFquired. The Board
shall submit to the Council an annual repor~ of its activities
and other such reports as may be required f)-om time to time.

The said BOard may appoint as it deems nece¡sary such committees to
act in an advisory capacity to the Board. ncarrying out the
provisions of this By-law, the said Board all at all times be the
agent of the Town of Kincardine and whiTe 1cting bona fide within
the limits of the authority of this By-law Ineither the Board nor
any memb.er thereof shall inc.ur any liabilio/ by reason of anything
done or left undone by the Board, provided Ihowever that nothing in

this paragraph contained shall author~ze or¡ empower the Board to
incur any debt,-liability, or obligation f r which the Town of
Kincardine shall become lIable without ha "ng previously obtained
the consent of the Council of the eorporat"on of the Town of
Kincardine. On or before the final day of ,Mârch each year, the
said Board shall submit to the Clerk Admin~strator for audit, a state-
ment of its financial affairs for the prec~ding year. The said Board
shall, by the last day of March in each ye~r, submit a budget to .the
Council for their approval and make a comPiete report-of the operationl
during the preceding year. The budget shai1 be detailed as required
by the auditor, as follows: i
i) Administrative & Oper4tional C@st
ii) Maintenance-Costs I
iii) Recreational Program ~osts
iv) Capital costs
4. The Council establish a Bank Account on be'àlf of the said Board
to be known as the Kincardine and DistrictCommunity Centre
Recreation Board. I

(a) The signing officer for the Bank Acco~t shall be the
appointed Secretary-Treasurer cf the oard.
(b) The books and the accounts of tbß sai Board shall be kept
by the Secretary-Treasu.rer of the sa d Board.
5. No debt or bbligation shall be incurred by the said Board.
6. The said Board may incur expenditures, as y be recommended
by th.e various sub-committees, to the extert provided in the
annual approved budget or as approved by Cpuncil.

The said BOard may prescribe fees for ajdmittance and rentals to
any part of the Community Centre and toi Recreational programs.

The said Board may solicit or receive ~y gifts or bequests of
money or services of any donations to ~e applied principal or

income for either the temporary or pe~nent use for
facilities, equipment, program or othe~ recreational purposes.
The said Board shall recommend to the ~unicipal Council of the
Town of Kincardine the hiring of all A4ministrative Staff
and other full time staff that is reqU~red to maintain and
operate the Community Centre and necre~tion Programs.
The said BOard may hire additional par~ time workers on a paid
or voluntary basis and shall be respon~ible for assigning the
duties and re.eponsibilities of such pe~sons.
The Board shall conduct, encourage andiassist the programs
or recreation which will meet the need~ and interests-of the
inhabitants of the MunicipaHties. Su~h programs shan
include the social, cultural and physiqal-aspects of recreation
as applied to all ages both male and f1male. The Board shall,
at aÌI times, promote the facilities a1d amenities which are
available for-recreation. I
That By-laws 1503, 1564, and 3167 be a~d the same are hereby
repealed. i

That the BQard does nQt approve of Recrþ'ation Program Groups
building up Reserve Funds as long as sa~d groups are being fin-
anced by Taxpayers Dollars. I

ordinator of Connaught Park.: .
That all Kin~ardine and District commun~ty Centre and Recreation
mail be delivered through the Town P.O.¡ Box and directed to us at
the Town Hall. _I _

The Board recommends no meetings be cal~ed on less than 24 hours
notice unless it is an emergency. L _

10. That this Board ado~t as policy, the fo' lowing, that all Board
members make every att~pt to attend al regular meetings and
special meetings called for this Board. If a member misses
three consecutive regular meetings with ut sufficient reason,
that member be_requested to resign from the ªoard.
Concessions only permitted by the Boardlbe allowed to opeæà~e
in all premises under the Board's contrpl.

1. That the minutes of all regular meeting and Department head
reports be_typed and mailed to each co ittee member and the
Recreation Director and Fac.ilities Mana ere Two copies of the
minutes will be forwarded to the Townsh"p Council and copies
to each õf the Town Councillors. The B dget Report for the prior
month will be attached to the minutes 0 the second meeting.
That advertising pertaining to Recreati n and Community Centre
be placed in_both loc~l newspap~rs.

That the following policy be foïlowed r~' garding request-for
refunds of fees for recreational progra s:-"Refundswill be made
on a pro-rated basis only because of me ical reasons."
Th~t this Bo~rd supply the meeting fac~=' ities for the L.H.Z.R.A.
and the Minor Sports Group (under 18_ye rs) Executive_meetings
only when held in Kincardine, at the C unity Centre, free of
charge at the discretion of the Facilit~es Manager.
That this Board grant the Recreation Di~ector permission-to
attend all Lake Huron Zone Recreation A sociation general
meetings. . ,
