BY-LAW NO. 1..057
BEING A BY-LAW PROVIDING FOR THE CONTROL, LIfENSING AND
REGISTRATION OF DOGS WITHIN THE TOWN OF KINC~RDINE.

WHEREAS IT IS PROVIDED by Section 5 of THE DOG LICENSING and
LIVE STOCK and POULTRY PROTECTION ACT, Revised tatutes of Ontario
1970, Chapter 133, as amended that Councils of unicipalities may
pass by-laws for the licensing and regulating t e registration of
dogs for imposing a license fee on the owners 0 them.

THEREFORE the Council of the Corporatiþn of the Town of
Kincardine enacts as follows:

(a)
That By-law number 2273 of the Town

"Dog" shall mean either male, female, þr spayed female dog.
"Owner" shall include possessor or har~ourer; and
"OwneĊ'shall include possessed or harb~ured.
"Ticket" shall mean a serially numberef notice in triplicate
stating: !
Nature of alleged offence I
Date and time of alleged offence.
Dog tag number.
Name and address of owner.
Penalty for alleged offence I if paid within
prescribed time.
Time during which penalty i'y be paid out of court.
The ticket shall be signed y the Canine Control
Officer issuing the ticket þr other person authorized
by the Council of the Munictpality.
"Canine Control Officer" shall mean tht person designated
by the Municipal Council of the Corpor~tion of the Town of

Kincardine to enforce this by-law. .

1. Every owner or harbourer of a dog in t~e Town of Kincardine
shall within one week after the dog comes into ~is possession cause
such a dog to be licensed and registered in the 'office of the Clerk
of the Municipality for the period which will e ire on the last day
of December and shall thereafter annually on or before the fifteenth
day of February in each year cause such dog to e again licensed and
registered for one year from the first day of Jtnuary and shall at the
time of licensing and registration pay the lice1se fee applicable
thereto, which is hereby imposed upon such owne~ as follows:

For each male dog or spayed female.............~...........$3.00
For each additional male or spayed female dog..l...........$4.00
For each female dog............................~........... 6.00
For each additional female dog.................t........... 7.00
For each spayed dog, provided proof of the oper~tion is provided
in the form of a receipt from the veterinarian.f........... 3.00
For each Kennel of ~ure-bred dogs..............t...........25.00
Provided that where the owner acquired the dog ~fter expiration of

6 months .f the year he shall be charged only htlf of the dog tax.
2. Any owner not procuring a license for 'is dog on or before
the fifteenth day of February in each year shal~ have a ticket mailed
to him by registered mail to his last known pla+e of residence. Any
person issued a ticket under the provisions of ~his by-law for an
alleged contravention may within 48 hours after!the issuance thereof
voluntarily pay to the Canine Control Officer or such other person
designated by the Council of the Municipality t+ receive such payment
the sum of $10.00 for the first offence in any ,ne thirty-day period
and $15.00 for the second and subsequent offenct or offences in the
same thirty day period. This payment shall be teceived as the payment
of a penalty in full satisfaction with respect to the alleged offence
and a receipt therefor shall be given to the petson making payment.
The owner shall also at this time purchase the tequired number of
licenses.

4. (a) On payment of the license fee refe~red to in Section 1,
the owner shall be furnished with a dog tag andlpaper license for
each dog so licensed and registered at a cost o~ twenty-five cents (25¢~
per tag. i
(b) The owner shall keep the current t~g securely fixed on
I
the dog at all times during the year, save and 1xcept that the tag
and collar may be removed while the dog is bein~ lawfully used for
hunting deer in the bush. '
(c) The tag shall bear a serial numberiand the year for
which it was issued and a record shall be kept ~y the Clerk or other
officer designated for that purpose, showing th~ name and address of
the owner and serial number of the tag.
(d) No person shall use a tag upon a d~g other than the dog
for which such tag was issued.
(e) No license or registration shall b~ transferrable and
the license and registration referred to in Sec~ion Ifof Part 111
shall expire and become void upon the sale, dea~h or otherwise disposal
of the dog to which such license and registrati1n relates.
5. A dog if found, whether on or off the qroperty upon which it
is habitually kept, whether or not under the co trol of any person,
without a tag, may be impounded in the dog poun. A dog so impounded
shall be held for a period of not less than TH E (3) days exclusive
of Saturday, Sunday and Public Holidays unless reviously claimed by
the owners thereof, and if not claimed by and r11eased to the owner
thereof within such period of time may then be ~old, destroyed or
otherwise disposed of at the discretion of the ~oundkeeper, the owner
thereof shall pay the Canine Control Officer orother designated officer
a sum of $10.00 plus the sum of $5.00 for each ~aY or part thereof
after the first day during which such dog has b en impounded. The cost
of destroying any dog shall also be borne by th owner.
6. Any person who contravenes the provisi~ns of paragraphs one
and two is liable to a fine of not less than $lq.OO and not møre~an
$50.00 {~~~~iyeof costs) for each contraventi~n, and' any person who
contravenes the provisions of paragraph 4(d) is 'liable to a fine of not
less than $10.00 and not more than $20.00 for e ch contravention; every
such penalty shall be recoverable under the S ry Convictions Act, all
proV1s10ns of which shall apply except that imp isonment may not ex&èed
twenty-one (21) days for each contravention.

PART IV

RUNNING AT LARGE OF DOGS
1. For the purpose of this part a dog shal~ be deemed to be
running at large when fO\md ill any place other th¡an the prellises of the
owner of the dog and not under the control of an~ person.
2. The rnnnil'\g at large of dogs is prohibi~ed within the MunicipaJ.ity.
3. A dog which is found running at large cOftrary to the provisions
of this part may be seized and ilapounded in the ~g pound; a dog so
impounded shall be held for a period of not less ¡than THREE (3) days
exclusive of Saturday, Sunday and Public Holiday~ and if not claimed by

and released to the owner thereof wi thin such a ~eriod of tilae, may then
be sold, destroyed or otherwise disposed of at t~e discretion of the
poundkeeper; except that where a dog running at ~arge has been injured
to the extent that a veterinarian is of the opiniþn that such dog should
be destroyed forthwith, the Canine Control Officelr may authorize such
veterinarian to destroy such dog immediately; a ~Og so seized or impounded
shall not be released until the owner thereof sha1l pay to the Canine

Control Officer or other person designated by th~ Council of the Municip-
ality, the sum of $5.00 for maintenance for each þay CIIr part thereof
after the first day during which the dog has be~ so iapounded plus a

penalty of $10.00 in the case of a dog impounded Ifor the first time, a
penalty of $20.00 in the case of a dog impounded Ifor the second time, a
penalty of $50.00 in the case of a dog impounded fCilr a third time or
subsequent time iD any thirty day period. :
4- (a) If the owner or guardian of an impo*ded dog can be identified
said owner shall be notified by the Canine controþ. Officer, which notific-
ation shall be sufficiently given if sent by fir~ class mail (prepaid)
to the last knøwn place of residence of said ownelr. If the dog is not
claimed within three (3) days exclusive of saturdJaY, Sunday and Public
Holidays and said dog is destroyed then the Cilwne1j shaJ.l bear the cost
of destruction. I
5. Every Oder of a dog who contravenes thijs By-law is guilty of an
offence and on S"-"t'Y Convic\ion is liable to a fine of not more than
FIFTY ($50.00) dollars exclusive of costs. i
6. The emall animals which aay be destroye~ under the provisions
of this by-law shall be those seized or impound~ by the Canine Control
Officer, Police, or any other person designated ~y Council.
