THE CORPORATION OF THE TOWN OF KINCARDINE
BY-LAW NO. 4112
BEING A BY-LAW TO REGULATE PARKING OF VEHICLES N PUBLIC STREETS IN
THE TOWN OF KINCARDINE WITHIN CERTAIN HOURS
.
WHEREAS it is deemed necessary to prohibit and regulate
the parking of vehicles on the highways within he Corporate
limits of the Town of Kincardine between the ho s of 3:00 A.M.
and 6:00 A.M. I
AUTHORITY: Section 460 of The Municipal Act, C pter 284, R.S.O.,
1970, which states:
"The Councils of all municipalities y pass by-laws:
1. For prohibiting or regulating th obstructing,
encumbering, injuring or fouling of highways or
bridges."
NOW THEREFORE the Municipal Council of the Corporation of
the Town of Kincardine ENACTS as follows:
1. For the purpose of this By-law the following definitions shall
apply:
HIGHWAY - includes a common and public hig ay, street,
avenue, driveway, square, place, bridge, vi duct or trestle,
designed and intended for, or used by, the general public
for the passage of vehicles;

4. The driver or the owner of any vehicle parked in contravention
of this By-law shall be liable to:
i) Where the owner or deiver of such a vehic admits breach
of this By-law payment of a fee, charge 0 penalty in
the amount of $5.00 payable within 48 hour of being so
charged by the leaving of a ticket to that effect on such
vehicle, payable to the Town of Kincardine at the Town
Clerk's Office in the Town of Kincardine; r

4. ii) Where such owner or driver has not availE d himself of the
procedure set out in subparagraph (i) of this paragraph
he shall be subject to a penalty of $12.( 0, exclusive of
costs, and all such penalties shall be rEcovered under the
Summary Convictions Act.
5. The Police Department of the Town of Kincardine have authority,
in addition to any fee, charge or penalty helein before set out
to remove any such vehicle in breach of this By-law from the
highway at the expense of the owner thereof.

6. By-law No. 4109 be and is hereby repealed.
