I BY-LAW NUMBER 3157 : , LEGISLATION: Municipal Act Section 460 & 354, +. s. 55, 56 & 57 i BgING a By-law respecting the removal of snow a+d ice from the sidewalks in certain areas of the Town of Kincafdine and from the roofs of public buildings in the said Town. I THE MUNICIPAL COUNCIL OF THE TOWN OF KINCARDINE enacts as follows: 1.- The occupants of commercial and indu trial buildings, except office buildings, and of all residences, i except apartment or tenament houses, and the owners of all OffiCi buildings, apartment or tenament houses, and of all other uildings, shall clear away and remove or cause to clear away th snow and ice on sidewalks in front of, alongside or at the rfar of such buildings, and also from the roofs of any such buildings wpich abut upon any sidewalk on the highway or upon any open space ~o which the public has access, and also from all fire escaprs and other means of egress. ! ! 2.- Such snow and ice shall be removed bY ten o'clock in the forenoon and again by four o'clock in thr afternoon of each day when the same accumulates and shall! be deposited on the roadway immediately adjacent to the curb~ but in such a way as not to obstruct access to any fire hydra t or any passage on the highway, and shall not be removed in suc manner as to injure the sidewalk. I 3.- No person or persons shall deposit or leave snow, refuse, goods, wares, cartons, merchandise (except whe~ such merchandise is actually being moved into or out of stores and;' ther premises for the purposes of receiving or shipping), or any ther article or articles upon any sidewalk, street, lane, alle or highway within the boundaries of the Municipality. ; 4.- No person shall place any snow or i1e from his property upon any highway in the Town of Kincardine. , 5.- The owners and occupants of all pub ic buildings in the Town of Kincardine shall ensure that ation of snow or ice on the roofs shall all be removed er and so often as the same shall constitute a hazard to bers of the public using such buildings. ' 6.- In case of default of compliance wiJh the foregoing, the Town of Kincardine through its officers th4 Chief of Police or the Road Superintendent may clear away and amove such snow and ice, and the expense incurred in so doing y be recovered by action, or the amount may be entered in the Tax Collector's rolls and recovered in like manner as municip taxes. ~ , - 2 - . 7.- The Town of Kincardine may clear awar and remove snow and ice from the roofs of all unoccupied bþildings , which abut upon any sidewalk on the highway, or upon any open space to which the public has access, and rrom the sidewalks on the highways in front of, alongsidr or at the rear of any unoccupied building or of vacant la~d, and the expense incurred in so doing may be recovered by action, or the amount may be entered in the Tax Collector'~ rolls and recovered in like manner as municipal taxes. I I , 8.- The Chief of Police or the Road Supetintendent shall also have authority to cause to be levelled or ~anded or both, any sidewalk or roadway, or part of a sidewalk ~r roadway, which , is in a condition of non-repair by reason of sn~w or ice. . To~ of Kincardine I fot the penalty for 10.- The provision of this By-law, other ~han the I prov~s~ons of paragraph 5, shall apply to: i Queen St. both sides, from South Durham Mtrket to Broadway; Harbour St. both sides, from Queen St. to Huron Terrace; Lambton St. both sides, from Princes St. to Huron Terrace; , i 11.- Any person guilty of any infraction ~f any of the provisions of this By-law shall, upon convictio~ before the Provincial Judge of the Province of Ontario, fotfeit and pay at the discretion of the said Judge a penaltý not ~xceeding the sum of $25.00 and such penalty shall be rec~verable and may be enforced under The Summary Convictions Act, fll the provisions of which shall apply, excepting thatithe imprisonment may be for any term not exceeding one month.
