THE CORPORATION OF THE TOWN OF KINCARD~NE

BY-LAW NO. ~

BEING A BY-LAW FOR PROHIBITING OR REGULATING ITHE USE OF ANY
LAND WITHIN THE MUNICIPALITY FOR DUMPING OR PISPOSING OF
GARBAGE, REFUSE, OR DOMESTIC OR INDUSTRIAL WP¡STE OF ANY KIND.
WHEREAS pursuant to the provisions of ~he Municipal Act,
R.S.O. 1974, Section 354 (1) (116) the Counc~ls of local muni-
cipalities may pass by.laws to prohibit or r~gulate the dis-
posing of waste materials.
NOW THEREFORE, the Municipal Council o~ the Corporation
of the Town of Kincardine enacts as follows;
1. That a waste disposal site shall be es~ablished in the
Town of Kincardine in that part of the ¡said Town
described as follows:
(a) Lots 25, 26 and 27 on the East Side of ¡Princes Street
(b) Lots 35, 36 and 3.7 on the West side of !Victoria Street
2. The said waste disposal site is for th~ purpose of
disposing of the following waste mater~al only:
(a) household or domestic waste
(b) construction materials, including appl~ances and
furniture
(c) brush, dead trees and tree limbs
Any person disposing of any other mate~ials therein
shall be deemed to have violated the p~ovisions of this
B~l~. .
3.(a) Household or domestic waste may be depqsited on the
following days at the following times: ,
Saturdays only
8:00 A.M. - 1~:00 Noon
1:00 P.M. - 4:130 P.M.
- 8:00 A.M. to ]2:00 Noon
and
Monday through Friday -
(b)
No household or domestic wastes from o~tside the
Corporation of the Town of Kincardine ~hall be de-
posited on any waste disposal site wit~n the Corpora-
tion. :
All other permitted waste material maYbe deposited only
on the following days at the following ,times:

Mondays, Wednesdays & Fridays - 8:00 A.~. to 12:00 Noon and
1:00 P.M. to 4:30 P.M.

Saturdays only
- 8:00 A.~. to 12:00 Noon

The said waste disposal site shall be qlosed all day
each Sunday and all Statutory Holidays ¡observed by
municipal employees. i
No person without first having obtaine~ a permit in
writing from the Town Clerk and from alter Savage shall
remove any waste material from the sai site, the said
waste material being deemed to be the ~roperty of the
Town once deposited on the said site. .

The collection and removal of such hou

That a fence shall be constructed arO~d the said land
and a gate with a lock shall be placed in the said fence
and a man shall be engaged to be on du y as directed
by the Council of the Town of Kincard nee
All garbage, refuse and waste material* which are or
may be subject to bløwing away by the ~nd shall be
tied up or packaged or securely placedlin containers
before being deposited in or left at ~he waste disposal
site of the Town of Kincardine and all I such garbage,
refuse and waste materials shall be de~osited or left
as may be directed by the Custodian of-I such site and if
in the opinion of such Custodian, SUCh~'garbage, refuse
or waste materials does not comply wi h the provisions
of this By-law, he shall refuse to acc pt it.
Any person, firm or Corporation doing 4ny dumping at
the said dumping ground during any ho~ other than at
the time as posted at the said dumping ground or dumping
any garbage, refuse or domestic or ind~strial waste
outside the fence at any time shall belprosecuted.
The collection, removal and disposal 0$ household or
domestic waste from the various reside~ces and places of
business within the Town of Kincardine I shall hereafter
be made by services to be supplied by ~he Municipal
Council of the Town of Kincardine. '

No person shall

The Municipal Council of the Town of K~ncardine is
hereby empowered to enter into a contr4ct with a person
or persons for the cOllection,;remOVal~and disposal of
such household or domestic waste on s ch terms and con-
ditions as may from time to time be de ided upon by the
said Council. I

The person or persons whose duty it bef.omes from time to
time to collect such household or dome tic waste shall
remove from all dwellings, apartment b °ldings and places
of business in the said Town, all hou ehold or domestic
waste (other than manure, leaves, limb of trees and
building debris) conveniently placed iq boxes or other
receptacles for removal at least once week as here-

Any person, whether acting personally ot through an
agent, representative or employee, and .ny such
agent, representative or employee who C¡ntravenes
any provision of this By-law or regulat ons is guilty
of an offence and on Summary Conviction is liable on
first conviction to a fine of not more han $100.00 and
on each subsequent conviction to a fine of not more than
$1,000.00 and in addition to any penaltt imposed under
the By-law any contravention of it may be restrained by
action of any ratepayer. i 0
