A By-law to regalate the parking of vehic¡ s and the control and use of Parking Meters. . WHEREAS it is provided by the Municipal M R.S.O. 1970 Chapter 2841 Section 460 and R.S.O. 1~70 Chapter: A4, Section J~2 1'l'Þ , a By-~aw may be passed by a Municipality t erect, maintain, operate Parking Meters on any' street, parts of s eets, sides of streets and parking lots as d.,fined J.n the By-la , and may further provide for penalties for the contravent n thereof and for payment of said penalties. , , AND WHEREAS the Council of the . CORPORATIO~ OF THE TOWN OF KINCARDINE deems it adv1.¡¡able to enact such al y-law. I NOW THEREFORE the Council of the CORPORAT TOWN OF KINCARDINE enacts as follows: 1.. That By-law Number 2130 TOWN OF KINCARDINE be,rescinded. , of the CO TION OF THE . 2. ' DE~ITIONS For the purpose of this By-law: Street or highway includes a common or public ðh ghway, street, avenue, parkway, driveway, square area, place, ot, bridge, viaduct or trestle, designed and Intended for or sed by, the general public for the passage of vehicles. THE CORPORATION OF THE TOWN OF KINC DINE BY-LAW NO. l¡.¡;0l BEING A BY-LAW TO AMEND BY-LAW 3120, A BY-LAW TO REGULATE THE PARKING OF VEHICLES AND THE CONTROL AND 0 E OF PARKING METRES I NOW THEREFORE the Council of the CORPORATION F THE TOWN I OF KINCARDINE enacts as follows: 1 THAT Section 14(a) and (b) of By-Law 312 be and the same is hereby deleted, effective Ja uary 1. 1983 1 I , da of December . (a) Any person who in consequence of hi business delivers goods, wares or merchandise to any pe son, temporarily or otherwise in the Town of Kincardine may app to the Clerk of the Corporation for a license to permit suc delivery and if such license is granted and the prescribed ,ee is paid, the operator of the commercial vehicle deliver·, g goods, wares or merchandise as aforesaid may occupy any of e individual parking areas within the said parking meters z es without using the said parking meters provided in parking the said commercial vehicle in any of the said areas the operator es not use the said areas for a period longer than is reasonab e necessary for the purpose of delivering the said goods, wares or merchandise, in no case for a period exceeding one hour, and provided further that if there is a lane at the rear or side of . he premises to which the goods, wares or merchandise are being' delivered, delivery shall be made from such lane and no pa king zone place or space shall be occupied. A sticker or plate, in the form approved by the Town CLerk shall be exhibited 0 the vehicle for which the license is granted. That Section 2 of By-law be amended by addiq the following definition: DRIVER includes owner. 2. That paragraph 16 be deleted and the follow~ g substituted: 16(a) 'rhe owner of a vehicle that is parked, stopped or left standing in contravention of this By-law is guilty of an offence and on convictioq is liable to a fine as defined in clause (b) of thi section unless the owner proves to the satisfa tion of the Court that at the time of the offence,: the motor vehicle was in possession of another Þ rson without the owner's consent, express or impli~ . 16(b) Any person violating any of the provi~ ons of this By-law shall be subject to a penalty q not more than Ten dollars for the first offence and not more than twenty-five dollars for every suþ equent offence, exclusive of costs, and all such pena~ ies shall be recoverable under the Summary Convict~ ns Act. ..
