BEING A BY-LAW TO AMEND ZONING BY-LAW 0.2003-25,
BEING THE COMPREHENSIVE ZONING BY-LA FOR THE
MUNICIPALITY OF KINCARDINE

Municipality of Kincardine (fonner Township of Ki cardine)
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chap r 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws hich comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipal ty of Kincardine has
enacted By-law 2003-25, a zoning by-law enacted under Se tion 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Muni ipality of Kincardine
desires to amend By-law 2003-25;
NOW THEREFORE the Council of the Corporation of the Muni ipality of Kincardine
ENACTS as follows:
1.
Schedule 'A' to By-law No. 2003-25 as amended, is hereby rther amended by
changing thereon from 'I' to 'R1-q' the zoning designation of hose lands
described as Part Lot 16, Concession 7 (being Part 2 on RP 3R-7579),
Municipality of Kincardine (former Township of Kincardine), hich are outlined on
the attached Schedule 'A'.
2. By-law 2003-25, as amended, is hereby further amended b adding the following
subsection to Section 12.3 thereof:
Notwithstanding their 'R1' zoning design tion, those lands
described as Part Lot 16, Concession 7 (bei g Part 2 on RP 3R-
. 7579), Municipality of Kincardine (former To nship of Kincardine)
and identified by the zone symbol 'R1-q' on S hedule 'A' to this By-
law, shall be used in compliance with the 'R1' zone provisions
contained in this By-law, excepting, however, t at:
(i) The minimum lot area shall be 1019.98 2; and
(ii) The minimum rear yard setback shall b 7.0 m.
3. This By-law takes effect from the date of passage by Counci and comes into
force and effect pursuant to the provisions of the Planning A ,R.S.O. 1990.
