NO. 2005 . 088
BEING A BY-LAW TO TEMPORARILY CLOSE STREETS T FACILITATE
THE 2005 KINCARDINE WOMEN'S TRIATHLO
WHEREAS Sections 8 and 9 of the Municipal Act, 2001, S.O. 2 01, c. 25, provide
municipalities with powers of a natural person to enable them to g vern their affairs as
they consider appropriate and to enhance their ability to respond to municipal issues;
AND WHEREAS pursuant to the said Municipal Act, Section 11 (2 provides that lower-
tier municipalities may pass by-laws within the sphere of juris iction of highways,
including parking and traffic on highways;
AND WHEREAS the Kincardine Women's Triathlon organiz ng committee has
requested that portions of Huron Terrace, south of Lambton Stre t, and Penetangore
Row southerty to Saratoga Road be closed on Saturday, July 16, 005 from 9:15 a.m.
to 11 :15 a.m. in order to hold the Fifth Annual Kincardine Women's Triathlon
NOW THEREFORE the Council for The Corporation of the Muni ipality of Kincardine
ENACTS as follows:
1.
That portion of Huron Terrace, southerly from Lambton S reet to Albert Street
and that portion of Penetangore Row from Albert Street t Saratoga Road, be
closed to all vehicular traffic, other than those vehicle authorized by the
organizers, on Saturday, July 16th, 2005, from 9:15 a.m. 11:15 a.m. for the
purpose of holding the 5th Annual Kincardine Women's Triat Ion.
2. The Kincardine Women's Triathlon Committee shall erect t each end of such
highway or portion thereof, and where an alternative route eviates therefore, a
barricade upon which an adequate waming device shall be xposed and in good
working order continuously from sunset until sunrise and at such points there
shall be erected a detour sign indicating the alternative ro te and containing a
notice that the highway is closed to traffic.

Every person who uses a highway or portion of a highwa

Every person who without lawful authority uses a highway or portion thereof so
closed to traffic while it is protected in accordance with th s paragraph, or who
removes or defaces any barricade, device, detour sign or ; otice placed thereon
by lawful authority, is guilty of an offence and is subject t the penalties as set
forth in the Provincial Offences Act and is also liable to T e Corporation of the
Municipality of Kincardine for any damage or injury occasio ed by such wrongful
use, removal or defacement.

5. This by law shall come into full force and effect upon its final assage.
6. This by-law may be cited as the "Kincardine Women's Tri thlon (2005) Road
Closing By-law".
READ a FIRST, SECOND, and a THIRD time and FINALLY PAS ED this 15th day of
June 2005.
