HomeMy WebLinkAbout04 063 agreement tiverton plaza TIlE CORPORATION OF TIlE MUNICIPALITY OF KINC INE e BY-LAW NO. 2004 - 63 BEING A BYLAW TO AUTHORIZE THE SIGNING F A LEASE AGREEMENT FOR RENTAL SPACE IN THE TIVERTO PLAZA WITH YOUNG-JIN SONG AND MIN-JA SONG e WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25 Secti ns 8 and 9 (1) provides municipalities with powers of a natural person to enabl them to govern their affairs as they consider appropriate under this or any other ct; AND WHEREAS the Council for the Municipality of Kinc rdine deems it advisable to enter into a lease agreement with Young-Jin Song nd Min-Ja Song in consideration of the rents, covenants and obligations stipulat therein; AND WHEREAS those certain premises are comprised of ap roximately 1210 sq. ft. of rentable area on the ground floor of the Tiverton Plaza situated on Lots 1,2 and 3, Plan 157, Queen Street North Side, former Village of Tiverton, now Municipality of Kincardine, County of Bruce, and being the cen re portion of the building. NOW THEREFORE the Council for The Corporation of th Municipality of Kincardine ENACTS as follows: 1. e 2. 3. 4. That the Municipality of Kincardine enter into a lease agree ent with Young- Jin Song and Min-Ja Song for the rental of space in the Tive on Plaza. This By-law shall come into full force and effect upon its final passage. This By-law may be cited as the "Tiverton Community Medi al ClinicfTourism Kiosk Lease Agreement, By-law". I J'HIS SHORT FORM LEASE made as of the ~ day of ,2004 !1¡:¡1 BETWEEN: THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE (hereinafter called the "Tenant") -and- YOUNG-JIN SONG & MIN-JA SONG (hereinafter called the "Landlord") WHEREAS the Landlord has agreed to lease to the Tenant approximately 1210 sq. ft. of rentable area on the ground floor of the Tiverton Plaza (''the building'') situated on Lots 1,2, and 3, Plan 157, Queen Street North Side, former Village of Tiverton, now Municipality of Kincardine, County of Bruce, and being the centre portion of the building. NOW THEREFORE for Two Dollars ($2.00) and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Landlord and the Tenant agree as follows: I. The Landlord hereby leases to the Tenant the centre portion of the Tiverton Plaza, which is approximately 1210 square feet in size, for purposes associated with both the medical services and tourism. 2. The Tenant shall pay as rent to the Landlord as follows: a) Rent (per month) 2004 $554.58 + GST = $593.40 + $60.00 = $653.43 2005 $554.58 + GST = $593.40 + $60.00 = $653.43 2006 $604.58 + GST = $646.90 + $60.00 = $706.90 2007 $604.58 + GST = $646.90 + $60.00 = $706.90 2008 $604.58 + GST = $646.90 + $60.00 = $706.90 b) Property Tax 1/3 of property tax ($195.34 per month) c) Maintenance 113 of maintenance ($150.00 per month) 3. The term of this agreement shall commence January 1st, 2004 and there shall be no fixed termination date for the Tenant's occupancy of the space. The Landlord or the Tenant shall have the right to terminate this Agreement, without penalty, upon giving the other party not less than two (2) months notice in writing 4. The Tenant shall be responsible for furnishing the Space. The Tenant shall not make any major installation, alteration, addition or improvement to the Space without advance written permission from the Landlord. The Landlord shall be responsible for providing waste collection. 5. The Tenant shall throughout the term of this Agreement provide and keep in force general liability insurance in an amount not less than one million ($1,000,000.00) dollars. . . . . . -2 - 6. All notice given or required to be given under this Agreement shall be in writing, signed by the party giving notice and personally delivered or transmitted by facsimile transmission to the Tenant at: Municipal Administration Centre, 1475 Concession 5, R.R. #5, Kincardine, Ontario, Attention: John deRosenroll, Fax No.: (519) 396-8288; and Landlord at 496 Queen St S., Paisley, Ontario Attention: Y oung-Jin Song and Min-Ja Song Fax No.: (519) 353-5221. Any notice or document so given shall be deemed to have been received on the date of personal delivery or on the next business day if transmitted by facsimile transmission. IN WITNESS WHEREOF the parties hereto have executed this agreement as evidenced by the hands of their proper signing officers duly authorized in that regard.
