HomeMy WebLinkAbout05 087 Agree Campbell e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCA INE BY-LAW NO. 2005 - 087 BEING A BY-LAW TO AUTHORIZE THE SIGNING OF AN AGREEMENT TO PERMIT THE CONSTRUCTION OP A DWELLING WITH THE CONDITION OF REMOVAL OF THE EXISTING DWELLING (Paul Campbell - Lot H, Concession 2, Ward 3) WHEREAS Section 9 (1) of The Municipal Act, 2001, 5.0. 2001, c. 25, as amended, confers authority on municipalities to enable them to govem their affairs as they consider appropriate and to enhance their ability to respond to municipal issues and Section 9 (3) authorizes municipalities! to pass by-laws respecting matters and imposing conditions as a requirement for obtaining a permit; AND WHEREAS Council, sitting as Committee of the Whole, has recommended that the Corporation of the Municipality of Kincardine enter into an agreement with Paul Campbell to allow for the construction of a second dwelling, with the condition of the removal of the existing dwelling on property known municipally as 1513 Concession 2, Municipality of Kincardine (former Township of Bruce); AND WHEREAS the Council for The Municipality of Kincardine deems it advisable to enter into an agreement with Paul Campbell for the removal of the existing dwelling; NOW THEREFORE the Council for the Municipality of Kincardine ENACTS as follows: 1. That the Municipality of Kincardine enter into an agreement with Paul . Campbell for the removal of the existing dwelling on Lot H, Concession 2, 1513 Concession 2, Municipality of Kincardine (former Township of Bruce), County of Bruce by the 31" day of September 2006 or within six months of the issuance of an Occupancy Permit; 2. That the Mayor and CAO be authorized to sign, on behalf of The Municipality of Kincardine, the agreement with Paul Campbell attached to this by-law as Schedule "An. 3. This By-law shall come into full force and effect upon its final passage. 4. This By-law may be cited as the "Campbell (#1513 Lot H, Concession 2) Removal of Existing Dwelling Agreement, By-law'.
