HomeMy WebLinkAbout05 083 road closure canada day e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE NO. 2005 - 083 BEING A BY-LAW TO TEMPORARILY CLOSE STREETS TO FACILITATE JULY 1 - 3, 2005 CELEBRATIONS IN THE MUNICIPALITY OF KINCARDINE INCLUDING THE KINCARDINE CANADA DAY MUSIC FESTIVAL, THE KINCARDINE SCOTTISH FESTIVAL, CRUISE NIGHT AND CANADA DAY CELEBRATIONS WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, Sections 8 and 9 provide municipalities with powers of a natural person to enable them to govem their affairs as they consider appropriate and to enhance their ability to respond to municipal issues; AND WHEREAS pursuant to Section 11 (2) of the said Municipal Act, lower-tier municipalities may pass by-laws within the sphere of jurisdiction of highways, including parking and traffic on highways; AND WHEREAS the Council for the Municipality of Kincardine has given its support to the Kincardine Canada Day Music Festival, to be held simultaneously with the Kincardine Scottish Festival, Kincardine Cruise Night and Canada Day Celebrations from July 1 through July 3, 2005; AND WHEREAS the Council for the Municipality of Kincardine deems it advisable to temporarily close certain streets within the municipality to restrict unauthorized traffic in order to ensure a safe and orderly weekend: NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: That part of Queen Street northerly from Durham Market North to Durham Street; and that part of Lambton Street, from the west side of Princes Street westerly to the east side of Huron Terrace, be closed to all vehicular traffic, other than those vehicles authorized by the organizers, from 5:00 p.m. to 9:00 p.m. July 1, 2005 to facilitate the Drift-In Cruise Night. 2. That part of Durham Market South, easterly from Queen Street to Princes Street, be closed to all vehicular traffic, other than those vehicles authorized by the organizers, from 6:00 a.m. July 1, 2005 to 6:00 p.m. July 3, 2005 to facilitate the Kincardine Scottish Festival. 1. 3. That part of Durham Market North, easterly from Queen Street to Princes Street be closed to all vehicular traffic, other than those vehicles authorized by the organizers, from 6:00 a.m. to 6:00 p.m. Saturday, July 2, 2005 to facilitate the Kincardine Scottish Festival. 4. That part of Princes Street, southerly from Lambton Street to the Penetangore River, be closed to all vehicular traffic, other than those vehicles authorized by the organizers, from 6:00 a.m. to 6:00 p.m. Saturday, July 2, 2005 to facilitate the Kincardine Scottish Festival. .. ./2 e 5. e e e 2005 Canada Day Weekend Celebration By-Law By-law No. 2005 - 083 Page 2 That part of Russell Street westerly from Olde Victoria Street westerly to Victoria Park be closed to all vehicular traffic, other than those vehicles authorized by the organizers, from 6:00 a.m. to 6:00 p.m. on Saturday, July 2, 2005 to facilitate the Scottish Festival. 6. That part of Lambton Street from the entrance to Royal Canadian Legion, 219 Lambton Street, easterly to Queen Street be closed to all vehicular traffic other than those vehicles authorized by the organizers from 11 :30 a.m. to 1 :00 p.m. on Saturday, July 2, 2005 to facilitate the Scottish Festival Clan Parade. 7. That part of Queen Street southerly from Lambton Street to Gordon Street be closed to all vehicular traffic other than those vehicles authorized by the organizers from 11 :30 a.m. to 1 :00 p.m. on Saturday July 2, 2005 to facilitate the Scottish Festival Clan Parade. 8. That part of Lambton Street from the entrance to Royal Canadian Legion, 219 Lambton Street, easterly to Queen Street be closed to all vehicular traffic other than those vehicles authorized by the organizers from 10 a.m. to 12:30 p.m. on Friday, July 1, 2005, to facilitate the Canada Day Parade. 9. That part of Queen Street southerly from Lambton Street to Harbour Street be closed to all vehicular traffic other than those vehicles authorized by the organizers on Friday, July 1, 2005 from 10:00 a.m. to 12:30 p.m. on July 1, 2005 to facilitate the Canada Day parade. 10. That part of Harbour Street westerly from Queen Street to Lake Huron be closed to all vehicular traffic other than those vehicles authorized by the organizers from 10 a.m. to 12:30 p.m. on July 1, 2005 to facilitate the Canada Day parade. 11. That part of Queen Street northerly from Durham Market North to the Quinn Plaza, 933 Queen Street, be closed to all vehicular traffic other than those vehicles authorized by the organizers from 7:45 p.m. to 9:00 p.m. on Saturday, July 2, 2005 to facilitate the Kincardine Scottish Pipe Band Parade. 12. That part of Concession 5 westerly from Highway 21 to the westerly entrance of the Municipal Administration Centre, 1475 Concession 5, be closed to all vehicular traffic other than those vehicles authorized by the organizers from 12:00 noon to 12:00 midnight on both Friday, July 1, 2005 and Saturday, July 2, 2005 to facilitate the Kincardine Canada Day Music Festival. 13. That both entrances to the Municipal Administration Centre, 1475 Concession 5, be closed to all vehicular traffic other than those vehicles authorized by the organizers from 8:00 a.m. on July 1, 2005 to 1 :00 a.m. on July 3, 2005. 14. That parking be restricted to the westerly side of OIde Victoria Street on Friday, July 1, through to and including Sunday, July 3, 2005. 15. That all dogs be prohibited from Victoria Park from 3:00 p.m. on Friday, July 1, 2005 to 8:00 p.m. on Sunday, July 3, 2005 to facilitate the Kincardine Scottish Festival. 16. That organizers shall erect at each end of such highway or portion thereof, and where an altemative route deviates therefore, a barricade upon which an adequate warning device shall be exposed and in good working order continuously from sunset until sunrise and at such points there shall be erected a detour sign indicating the altemative route and containing a notice that the highway is closed to traffic. . ../3 e e e e I 2005 Canada Day Weekend Celebration By-Law By-law No. 2005 - 083 Page 3 17. Every person who uses a highway or portion of a highway so closed to traffic does so at his or her own risk and The Corporation of the Municipality of Kincardine is not liable for any damage sustained by a person using the highway or portion thereof so closed to traffic. 15. Every person who without lawful authority uses a highway or portion thereof so closed to traffic while it is protected in accordance with this paragraph, or who removes or defaces any barricade, device, detour sign or notice placed thereon by lawful authority, is guilty of an offence and is subject to the penalties as set forth in the Provincial Offences Act and is also liable to The Corporation of the Municipality of Kincardine for any damage or injury occasioned by such wrongful use, removal or defacement. 16. This by law shall come into full force and effect upon its final passage. 18. This by-law may be cited as the "2005 Canada Day Weekend Celebration By- law".
