THE CORPORATION OF THE MUNICIPALITY OF KINC INE
BY-LAW
No. 2004 - 57
BEING A BY·LAW TO AMEND ZONING BY-LAW 0.76-13,
BEING THE COMPREHENSIVE ZONING BY-LAW OR THE
TOWNSHIP OF BRUCE

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapte 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws which comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Township of Bruce has enacted
By-law 76-13, a zoning by-law enacted under Section 34 of the said lanning Act;
AND WHEREAS the Corporation of the Township of Bruce has re~ructured to now be
a part of the Corporation of the Municipality of Kincardine; I
AND WHEREAS the Council of the Corporation of the Munici~ality of Kincardine
desires to amend By-law 76-13;
NOW THEREFORE the Council of the Corporation of the Munic pality of Kincardine
ENACTS as follows:
1.
Schedule 'A' to By-law No. 76-13 as amended, is hereby furt er amended by
changing thereon from 'A' to 'A-57-a', the zoning designation fthose lands
described as Part Lot 17, Concession 8, Municipality of Kin rdine (former
Township of Bruce) which are outlined on the attached Sche ule 'A'.
2. By-Law No. 76-13, as amended, being the Comprehensive Z ning By-Law for
the Township of Bruce, is hereby further amended by adding the following
paragraphs to Section 5.1 thereof:
5.11 Notwithstanding their 'A' Zoning designation, those lands described as
Part Lot 17, Concession 8, Municipality of Kincardine (former Township of
Bruce), and delineated as 'A-57-a' on Schedule 'A' t this By-law may be
used for non-farm residential purposes in complian e with the 'A' Zone
provisions contained in this By-law, excepting howeve , that:
(i) The number of livestock units shall be Ii ited to 3.7 livestock
units per hectare;
(ii) Existing buildings and structures may e permitted as they
existed on November 5, 1991;
(iii) The minimum lot area shall be 1.9 hecta es; and
(iv) The minimum lot frontage shall be 83 m tres.
3. This By-law takes effect from the date of passage by Counci and comes into
force and effect pursuant to the provisions of the Planning A ,R.S.O. 1990.

BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 76-13,
BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE
TOWNSHIP OF BRUCE

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of
Municipalities to enact and amend zoning by-laws which comply with an approved official plan;
AND WHEREAS the Council of the Corporation of the Township of Bruce has enacted By-law
76-13, a zoning by-law enacted under Section 34 of the said Planning Act;
AND WHEREAS the Corporation of the Township of Bruce has restructured to now be a part of
the Corporation of the Municipality of Kincardine;
__ AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to
amend By-law 76-13;

NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine ENACTS
as follows:
1. Schedule 'A' to By-law No. 76-13 as amended, is hereby further amended by changing

17, Concession 8, Municipality of Kincardine (former Township of Bruce) which are
