BEING THE COMPREHENSIVE ZONING BY-LÞ: FOR THE
MUNICIPALITY OF KINCARDINE

WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapt r 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws hich comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipal ty of Kincardine has
enacted By-law 2003·25, a zoning by-law enacted under Se ion 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Muni ipality of Kincardine
desires to amend By-law 2003-25;
NOW THEREFORE the Council of the Corporation of the Muni ipality of Kincardine
ENACTS as follows:
Schedule 'A' to By-law No. 2003-25 as amended, is hereby urther amended by
changing thereon from 'Ai-a' to 'A1-j' and 'A1-e', the zoning designation of those
lands described as Lot 17, Concession 8, Municipality of Ki cardine (former
Township of Bruce) which are outlined on the attached Sch dule 'A'.
2. By-Law No. 2003-25, as amended, being the Comprehensi e Zoning By-Law for
the Municipality of Kincardine, is hereby further amended b adding the following
paragraphs to subsection 9.3 thereof:

9.3.5 Notwithstanding their 'Ai' Zoning designation, tho e lands described as
Part Lot 17, Concession 8, Municipality of Kincardin (former Township of
Bruce), and delineated as 'A1-e' on Schedule 'A' this By-law may be
used in compliance with the 'Ai' Zone provisions co tained in this By-law,
excepting however, that:
(i) No residential buildings or structures s all be permitted; and
(ii) The minimum lot area shall be 38.46 h ctares.

9.3.9 Notwithstanding their 'Ai' Zoning designation, those I~nd$ described as
Part Lot 17, Concession 8, Municipality of Kincardine «(ormer Township of
Bruce), and delineated as 'A1-j' on Schedule 'A' to t~is By-law may be
used for non-farm residential purposes in compliance ¡with the 'Ai' Zone
provisions contained in this By-law, excepting however,that:

The number of livestock units shall be limIted to 3.7 livestock
units per hectare;
Existing buildings and structures may b~ permitted as they
existed on November 5, 1991; !
The minimum lot area shall be 1.9 hectar$s; and
The minimum lot frontage shall be 83 metlres.
This By-law takes effect from the date of passage by Council ~md comes into
force and effect pursuant to the provisions of the Planning Act~ R.S.O. 1990.
This By-law may be cited as the "Amendment to Comprehensive Zoning By-law
2003-25, (Lot 17, Concession 8, Municipality of Kincardine (former Township of
Bruce», By-Law.
