BY-LAW
No. 2004 - 53
BEING A BY-lAW TO AMEND ZONING BY-LAW 0.2003-25,
BEING THE COMPREHENSIVE ZONING BY-LA FOR THE
MUNICIPALITY OF KINCARDINE

(being Part 1 on RP 3R-1184), Municipality of Kincardine (fo er Township of
Bruce)
WHEREAS Section 34 of the Planning Act, RS.O 1990, Chap er 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws hich comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Municipa ity of Kincardine has
enacted By-law 2003-25, a zoning by-law enacted under Se tion 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Muni ipality of Kincardine
desires to amend By-law 2003-25;
NOW THEREFORE the Council of the Corporation of the Mun cipality of Kincardine
ENACTS as follows:
1.
Schedule 'A'to By-law No. 2003-25 as amended, is hereby further amended by
changing thereon from 'A2' to 'A2-e', the zoning designatio of those lands
described as North Part of Lot E, Concession 9 and the So th Part of Lot E,
Concession 10 (being Part 1 on RP 3R-1184), Municipality f Kincardine (former
Township of Bruce) which are outlined on the attached Sch ule 'A'.
2. By-Law No. 2003-25, as amended, being the Comprehensi e Zoning By-Law for
the Municipality of Kincardine, is hereby further amended b adding the following
paragraphs to subsection 10.3 thereof:
10.3.5 Notwithstanding their 'A2' Zoning designation, tho e lands described as
Part of North Part of Lot E, Concession 9 and th South Part of Lot E,
Concession 10 (being Part 1 on RP 3R-1184), Mu icipality of Kincardine
(former Township of Bruce), and delineated as ' e' on Schedule 'A' to
this By-law may be used in compliance with the 'A2' Zone provisions
contained in this By-law, excepting however, that:
(i) The minimum lot area shall be 27.4 h tares.

3. This By-law takes effect from the date of passage by Council élmd comes into
force and effect pursuant to the provisions of the Planning Act¡ R.S.O. 1990.

4. This By-law may be cited as the "Amendment to comprehens*e Zoning By-law
2003-25, (North Part of Lot E, Concession 9 and the South P rt of Lot E,
Concession 10 (being Part 1 on RP 3R-1184), Municipality of incardine (former
