THE CORPORATION OF THE MUNICIPALITY OF KINC INE
BY-LAW
NO. 2004 - 51
BEING A BY·LAW TO ACCEPT A TENDER FOR T E
SUPPLY OF WATER METERS
(Carson's Plumbing Supplies)
WHEREAS the Municipal Act, 2001, 5.0. 2001, c. 25 Sections 8 nd 9 (1) provides
municipalities with powers of a natural person to enable them to go ern their affairs as
they consider appropriate under this or any other Act;
AND WHEREAS the Municipal Act, 2001, 5.0. 2001, c. 25 Section 1 (2) provides that
lower-tier municipalities may pass by-laws within the sphere of j risdiction of water
distribution;
AND WHEREAS the Municipality of Kincardine adopted By-law No.2 04 - 28 to enact
rules and regulations for the installation, repair, maintenance, and acc ss to water meters
in the Municipality of Kincardine;
AND WHEREAS By-law No. 2004 - 28 provides that all water suppl ed through existing
and new private water services shall pass through a meter owned by he Municipality;
AND WHEREAS it has been determined that approximately 800 resi ential water meters
will be required by the Municipality of Kincardine, pursuant to Tende No. 2004 - 09, for
installation in 2004 and 2005.
AND WHEREAS it has been determined that the Municipality of Kin rdine will proceed
with Item #1 only of Tender No. 2004 - 09 at this time;
NOW THEREFORE the Council for the Municipality of Kincardine EN
1. That the tender of Carson's Plumbing Supplies in the am unt of $64,936.00,
excluding taxes, and representing Item #1 of Tender No. 2 04 - 09, be hereby
accepted for the purchase of 800 residential water meters.
2. That the Mayor and CAO be hereby authorized to sign, on half of the Council
for the Municipality of Kincardine any contracts and other d cuments required to
authorize the purchase.
3. This by-law shall come into full force and effect upon its final assage.
4. This by-law may be cited as the "Water Meter Purchas (Carson's) Tender
Acceptance By-law".
READ a FIRST, SECOND and THIRD TIME and DEEMED TO BE ASSED this 7'h day
of April 2004.

hereinafter called the "Contractor"
THE PARTY OF THE FIRST PART

The Municipality of Kincardine
hereinafter called the "Municipality"
THE PARTY OF THE SECOND PART

WITNESSETH, that the party of the first part, for and in consideration of the payment or payments
specified in the Tender for this work, hereby agrees to furnish all necessary machinery, tools,
equipment, supplies, labour, and other means of construction and, to the satisfaction of the Public
Works Manager, to do all the work as described hereafter, fumish all the materials except as herein
othelWise specified, and to complete such works in strict accordance with the plans, specifications
! and Tender therefore, which are identified and acknowledged in the Schedule of Provisions, Plans,
Specifications and Conditions attached to the Tender and all of which are to be read herewith and
fom1 part of this present Agreement as fully and completely to all intents and purposes as though all
the stipulations hereof have been embodied herein.
DESCRIPTION
Contract No. 2004-09 - Supply of Water Meters for a tendered price of $87,579.75, including
taxes.
IN CONSIDERATION WHEREOF, said party of the second part agrees to pay to the Contractor
for all work done, and the unit prices on the Tender.
This agreement shall ensure to the benefit of and the binding upon the heirs, executors,
administrators and assigns of the parties hereto.

and set their seals on the day first above written.
