THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
NO. 2005 . 077
BEING A BY-LAW TO ACCEPT A TENDER FOR THE PURCHASE AND
INSTALLATION OF SKATEPARK RAMPS AT THE MUNICIPALITY OF
KINCARDINE SKATE PARK
(Excel! Sport & Recreation Inc.)
WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25 Section 11 (2) provides that lower-
tier municipalities may pass by-laws within the sphere of jurisdiction of culture, parks,
recreation and heritage;
AND WHEREAS pursuant to the said the Municipal Act, Sections 8 and 9 (1) provide
municipalities with powers of a natural person to enable them to govem their affairs as
they consider appropriate and to enhance their ability to respond to municipal issues;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine deems
it necessary to purchase and install skateboard ramps at the Municipality of Kincardine
Skatepark to meet the needs and abilities of various age groups within the municipality;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine deems
it expedient to accept the tender of Excell Sport and Recreation Inc. for the purchase and
installation of 11 ramps and equipment at the Municipality of Kincardine skatepark ;
NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine
ENACTS as follows:
1.
That the tender of Excell Sport and Recreation Inc. of Cambridge, Ontario for the
supply and installation of skatepark equipment, in the amount of $46,725.00,
excluding taxes, be hereby accepted.
That the Mayor and CAO be hereby authorized to sign, on behalf of the Council
for The Corporation of the Municipality of Kincardine any contracts and other
documents required to authorize the purchase and installation of the equipment.

3. This by-law shall come into full force and effect upon its final passage.
4. This by-law may be cited as the "Skatepark Equipment (2005) (Excell Sport)
Tender Acceptance By-law".
READ a FIRST, SECOND and THIRD TIME and FINALLY PASSED this 18th day of
May, 2005.
