THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2005 - 065
BEING A BY -LAW TO REPEAL BY-LAW NO. 2000 - 80, DEEMING BY-LAW
FOR LOTS 23 & 24, PLAN 3M-59
WHEREAS the Planning Act, R.S.O. 1990 c. P13, Section 50 (4) authorizesJhe..Council
of a Municipality to pass a By-law designating any Plan of Subdivision or part thereof,
that has been registered for eight years or more, not to be a registered Plan of
Subdivision for the purposes of Subsection 50 (3) of the Planning Act;
AND WHEREAS the Municipality of Kincardine adopted By-law No. 2000 - 80, deeming
Lots 23 and 24, Registered Plan 3M-59, in the former Town of Kincardine, County of
Bruce, not to be a registered plan of subdivision for the purposes of Subsection 3 of
Section 50 of the Planning Act, R.S.O. 1990;
AND WHEREAS pursuant to Sections 8 and 9 (1), of the Municipal Act, 2001, S.O.
2001, c.25, as amended, municipalities are provided with powers of a natural person to
enable them to govem their affairs as they consider appropriate and to enhance their
ability to respond to municipal issues;
AND WHEREAS the Council for the Corporation of the Municipality of Kincardine has
received a request to return Lots 23 and 24 to their original status as part of Registered
Plan of Subdivision 3M-59 and determined that the repeal of By-law No. 2000 - 80
would be appropriate;
NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine
ENACTS as follows:
1. That By-law No. 2000 - 80, cited as the "Deeming By-law Lots 23 & 24, Plan 3M-
59", is hereby repealed.
2.
That Lots 23 and 24, Registered Plan 3M-59, assume their original status as part
of the Registered Plan of Subdivision 3M-59, registered in the Registry Office for
the Registry Division of the County of Bruce on the 4th Day of March 1982.
3. That the Clerk of the Municipality of Kincardine shall cause a certified copy of this
by-law to be lodged with the County of Bruce and to be registered in the Land
Registry Office for the County of Bruce as required by Section 50 (28) of the said
Planning Act.
4. This By-law shall come into full force and effect upon its final passage.
5. This By-law may be cited as the "Repeal of By-law 2000 - 80 (Lots 23, 24, RP
3M-59) By-law".
READ a FIRST, SECOND and THIRD TIME and FINALLY PASSED this 4d day of May
2005.

of the Registered Plan of Subdivision 3M-59, registered in the egistry Office for
the Registry Division of the County of Bruce on the 4'" Day of rch 1982.
3. That the Clerk of the Municipality of Kincardine shall cause a rtifled copy of this
by-law to be lodged with the County of Bruce and to be regi red in the Land
Registry Office for the County of Bruce as required by Section 0 (28) of the said
Planning Act.
4. This By-law shall come into full force and effect upon its final
