Home My WebLink About22 114 Traffic and Parking Amendment (6) By-lawTHE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2022 - 114 _________________________________________________________________________________________________ BEING A BY-LAW TO AMEND BY-LAW NO. 2019 – 165; BEING A BY-LAW TO REGULATE TRAFFIC AND PARKING IN THE MUNICIPALITY OF KINCARDINE _________________________________________________________________________________________________ WHEREAS the Municipal Act, S.O. 2001, c. 25 as amended, Sections 11(3) and 27(1), gives lower tier municipalities the power to pass by-laws within the sphere of jurisdiction dealing with highways; including parking and traffic; AND WHEREAS Section 245(1) of the said Municipal Act, authorizes a municipality to pass by-laws providing that a person who contravenes the by-law is guilty of an offence. AND WHEREAS the Highway Traffic Act, R.S.O., 1990, c. H.8 and the regulations made thereunder permit the councils of local municipalities to regulate traffic and parking; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine passed, on January 13th, 2019, By-law No. 2019 - 165 being a By-law to Regulate Traffic and Parking in the Municipality of Kincardine; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine passed By-law No. 2022 -084 to amend sections of By-law No. 2019 - 165 to increase fines per Legislative Report 2022 – 13, being made effective on July 1, 2022; AND WHEREAS the Municipality has not yet received approval of the set fines proposed for the enforcement of By-law No. 2019-165, and desires to amend the schedule of set fines, and the effective date; NOW THEREFORE, the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That Schedule ‘Z of By-law No. 2019 - 165, the By-law to Regulate Traffic and Parking in the Municipality of Kincardine, be hereby repealed and replaced with the attached Schedule “Z”; 2. That this by-law will take effect on October 17, 2022. 3. That this by-law may be cited as the “Traffic and Parking Amendment (6) By-law”. READ a FIRST, SECOND TIME this 20th day of June, 2022.
