HomeMy WebLinkAbout22 104 Amendment to Comprehensive Zoning By-law 2003-25, Bervie Sideroad (Albrecht) By-law THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW No. 2022 – 104 A BY-LAW TOAMEND ZONING BY-LAW NO. 2003 – 25, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE MUNICIPALITY OF KINCARDINE Levi and Rosena Albrecht CON 1 NDR PT LOT 50 RP;3R8426 PARTS 1 TO 3 WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine has enacted By-law 2003- 25, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of The Corporation of the Municipality of Kincardine desires to amend By-law 2003-25; NOW THEREFORE the Council of The Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby further amended by changing thereon from ‘Hamlet Commercial (C7 - a)’ Zone ‘Residential One (R1)’ Zone to ‘General Agriculture Special (A1-hc)’ Zone on those lands described asCON 1 NDR PT LOT 50 RP;3R8426 PARTS 1 TO 3 Kincardine (Township of Kincardine) as outlined on the attached Schedule ‘A’. 2. By-law No. 2003 - 25 as amended, is hereby further amended by adding the following subsection to Section 9.5 thereof: Notwithstanding the provisions of Section 9.1 #',)(..'&$-'-/"+* %,) !+. , on lands zoned ‘A1- hc’, the following uses shall also be permitted: a. Agriculture, General; however, the raising of livestock shall not be permitted and the raising of other animals for food shall be limited to a maximum of 6 poultry b. Small scale retailing of boilers and stoves c. Agriculture Produce Warehouse d. Farm Implement Establishment e. Bulk Sales Establishment – Agriculture f. Food Processing, Primary g. Food Mill and Elevator 3. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990.
