BEING A BY ·LAW TO ACCEPT A TENDER F R
SIDEWALK CONSTRUCTION/RECONSTRUCT ON
IN VARIOUS LOCATIONS WITHIN THE MUNICIPALITY 0 KINCARDINE
(C & M Construction Kincardine Ltd.)
WHEREAS under Section 55 of the Municipal Act, 2001, S. . 2001, c. 25, as
amended, that a lower-tier municipality in which highwa are located is
responsible for the construction and maintenance of the si ewalks and has
jurisdiction over that part of the highway;
AND WHEREAS it has been determined that construction and epair of sidewalks
is required in various areas of the municipality;
AND WHEREAS the Council for the Municipality of Kincardine
to accept a tender for the construction and reconstruction of idewalk repairs in
various locations around the Municipality pursuant to Contract N . 2004-05.
NOW THEREFORE the Council for the Municipality of Kinca ine ENACTS as
follows:
1. That the tender of C & M Construction Kincardine Ltd. in the amount of
$80,357.00, including all applicable taxes, be hereby acc pted.
That the Mayor and CAO be hereby authorized to sign on behalf of the
Council for the Municipality of Kincardine any con racts and other
documents required to authorize such work.
2.
3. This by-law shall come into full force and effect upon its fj al passage.
4. This by-law may be cited as the "2004 Sidewalks Tender Acceptance (C &
M Construction), By-law".

'WITNESSETH, that the party of the first part, for and in consideration of the payment or payments
I specified in the Tender for this work, hereby agrees to furnish all necessary machineI)', tools,
Ala 'equipment, supplies, labour, and other means of construction and, to the satisfaction of the Public

otherwise specified, and to complete such works in strict accordance with the plans, specifications
and Tender therefore, which are identified and acknowledged in the Schedule of Provisions, Plans,
Specifications and Conditions attached to the Tender and all of which are to be read herewith and
1 form part of this present Agreement as fully and completely to all intents and purposes as though all
¡the stipulations hereof have been embodied herein.
¡DESCRIPTION

taxes.
¡IIN CONSIDERATION WHEREOF, said party of the second part agrees to pay to the Contractor
for all work done, and the unit prices on the Tender.

administrators and assigns ofthe parties hereto.
